Who is collecting it?
Fermanagh and Omagh District Council is the Data Controller which means that we determine how the information is collected, used, protected and shared, where appropriate.
How is it collected?
This information could be collected:
• On Accident forms
• At Health & Safety Inspections
• During Health & Safety Investigations
• When a claim is received
This might be in person, via a telephone call, a written request or an email.
Why is it being collected?
The lawful basis we rely on for processing your personal data is article 6(1)(c) of the GDPR, meaning the processing is necessary for the Council to comply with a legal obligation.
How will it be used?
Information will be used to adhere to H&S legislation, obtain statistics & trends and to improve H&S in the workplace, and to fulfil the obligations and conditions under the Council’s insurance policies.
Who will it be shared with?
Internally – insurance department & relevant managers.
Externally – to HSENI where accidents are RIDDOR reportable, Council’s Insurance Broker and Insurance Companies.
How long will it be retained for?
All corporate health and safety information and insurance information will be retained as per the Council’s Records Retention and Disposal Schedule.
How do I make a data protection complaint?
If you consider that your data protection rights have been infringed because of the way Council has handled your personal information (or the personal information of someone you are acting on behalf of), you can make a data protection complaint to the Council by:

Data Protection complaints will be handled in line with the reporting periods outlined in the Council’s Complaints Handling Procedure.
