Tobacco retailers required to sign up to new register

Tobacco retailers operating in the Fermanagh and Omagh district must be registered to sell tobacco products under new legislation which came into effect on 6 April 2016.

The Tobacco Retailers Act (Northern Ireland) 2014 requires tobacco retailers across Northern Ireland to join the register by 1 July 2016. After this date it will be illegal to sell tobacco products if not registered to do so. Financial penalties for not being registered will range from £500 to £5,000 – the maximum fine applicable on summary conviction.

The new legislation is just one of a range of measures being introduced to reduce smoking among children and young people. In 2013, almost 1 in 4 adults in Northern Ireland smoked with two-thirds of smokers lighting up before the age of 18.

Fermanagh and Omagh District Council’s Environmental Health service has issued letters to tobacco retailers across the district to make them aware of the new register and their new legislative requirements under the Tobacco Retailers Act.

The tobacco retailers’ register is quick, easy and free to join by visiting www.tobaccoregisterni.gov.uk. Application forms are also available from Fermanagh and Omagh District Council’s Environmental Health service.

Further tobacco controls that came into force on 6 April 2016 under the Tobacco Retailers Act include the offence of proxy purchasing, whereby an adult buys a tobacco product for a person under the age of 18 and an increase in the maximum fine applicable for selling tobacco to a minor rising from £2,500 to £5,000.

Fermanagh and Omagh District Council has a statutory duty to enforce tobacco control legislation within the council district. Council Officers work across the district to ensure retailers comply with relevant legislation and take enforcement action where necessary.
